Emogent AI ("Emogent", "we", "our", or "us") is committed to protecting the personal data of our users, their leads, and all individuals whose information passes through our platform. This Privacy Policy explains what data we collect, how we use it, and your rights under the Digital Personal Data Protection Act, 2023 (DPDP Act) and applicable laws of the country.

1. Who We Are
Emogent AI operates as a B2B SaaS platform that enables real estate businesses (builders, brokers, agencies) to deploy AI-powered voice agents for lead engagement. Our registered contact address is:

2. Data We Collect
2a. From our customers (builders and real estate businesses)
- Name, email address, phone number, and company name at registration
- Billing and payment information (processed via third-party payment gateways; we do not store card details)
- CRM API credentials and configuration data you provide when connecting integrations
- Knowledge documents, property brochures, and content you upload to train your AI agent
- Usage data — call logs, session metadata, agent configuration, dashboard activity
2b. From lead data processed on behalf of customers
When your AI agent conducts outbound calls, Emogent processes data about the leads on behalf of our customers. This includes:
- Phone number, name, and email of the lead (provided by the customer)
- Call recordings and transcripts
- Sentiment and intent signals derived from calls
- Lead status, score, and follow-up schedule
Important: Emogent acts as a data processor for lead data. Our customers (builders) are the data principals responsible for obtaining consent from their leads to be contacted. Emogent processes this data solely on the customer's instructions.

3. How We Use Your Data
- To provide, operate, and improve the Emogent platform and services
- To authenticate users and manage your organisation account
- To process payments and manage billing
- To send service-related communications (account updates, security alerts)
- To send marketing communications — only if you have explicitly opted in
- To comply with legal obligations under Indian law
- To improve our AI models using anonymised, aggregated interaction data
We do not sell your personal data to any third party.
4. Data Storage and Security
All customer and lead data is stored on servers located in India (AWS, Mumbai — asia-south1 region), in compliance with data localisation requirements under the DPDP Act, 2023.
We implement industry-standard security measures including:
- Encryption in transit (TLS 1.2+) and at rest
- Role-based access controls (RBAC) for our team
- Regular security reviews and vulnerability monitoring
- Isolated per-organisation data storage
In the event of a data breach that poses significant risk to individuals, we will notify the Data Protection Board of India within 72 hours of discovery, and affected users as soon as practicable.
5. Data Sharing
We share your data only with:
- Service providers: Telephony providers (Exotel), cloud infrastructure (Google Cloud), AI providers (OpenAI, Anthropic, Google), vector database providers — strictly for delivering the service
- Payment processors: Razorpay or equivalent — for billing only
- Legal compliance: Government or regulatory bodies when required by Indian law
All third-party providers are under contractual obligations to process data only on our instructions and maintain appropriate security standards.
6. Data Retention
- Account data is retained for the duration of your subscription and for 90 days after account deletion, after which it is permanently erased
- Call recordings and transcripts are retained for 180 days by default (configurable)
- Billing records are retained for 7 years as required by Indian financial regulations
- Lead data is deleted upon request or when your account is terminated
7. Your Rights (DPDP Act, 2023)
Under the Digital Personal Data Protection Act, 2023, you have the right to:
- Access: Request a summary of personal data we hold about you
- Correction: Request correction of inaccurate or incomplete data
- Erasure: Request deletion of your personal data (subject to legal retention requirements)
- Grievance redressal: Lodge a complaint with our Grievance Officer
- Nominate: Nominate another individual to exercise rights on your behalf

8. AI Disclosure
Emogent's platform places AI-generated voice calls on behalf of our customers. Every outbound call identifies itself as an automated AI call within the first 15 seconds of the conversation. Call recipients (leads) are not misled into believing they are speaking with a human agent unless they explicitly request a human handoff.

10. Children's Data
